The California market is large enough that producers would find it worthwhile to look into a "guarana extract concentrate" (which would be caffeine plus several hundred other compounds) that could very easily exploit the bill’s language. In fact, the manufacturer of the pure caffeine currently in Four Loko may be able to lend some help with the language so that their product can be simply re-labeled and redeployed.

Ah, good call. Adding an ingredient that is not pure caffeine, but rather a mix of pure caffeine and something else, may be a way to abuse the spirit of the law. A better wording may prove necessary down the line.

"(a) Beer to which caffeine extract has been directly or indirectly added as a separate ingredient shall not be imported into this state, produced, manufactured, or distributed within this state, or sold by a licensed retailer within this state."

Funny enough 4 Loko Joose etc. already took all the stimulants out of their products. So the only company being hurt by this law will be Alesmith, etc.

From the California Small Brewers Association members forum:

NEWS FLASH
Governor Signs SB 39

Governor Jerry Brown has signed into law SB 39 (Padilla).

The bill (which takes effect Jan. 1st 2012) bans any malt beverage “which caffeine has been directly added as a separate ingredient…”

The CSBA worked extensively with the author to ensure that this bill did not include beer brewed with coffee, tea or chocolate.

We will have more details on this bill and AB 1014 next week.

Great posts, guys! -Peter
