Time to boycott Monster and all of its products, I’d say.

I’d have to agree. Any lawyers out there want to do some pro bono work?

Agreed. I sell about 3 cases a week at the place I manage. Guess I’ll switch to Full Throttle or Rockstar.

I have doubts about The Monster beverage company’s ability to say that this beer, the "Vermonster" is passing off as its own energy drinks. There are many other beers currently brewed in the United States using the word "monster" in it’s title, including the very popular Brooklyn Monster Ale. Funny they didn’t approach Brooklyn with the suit, but brooklyn probably has more resources and therefore more likely to litigate.

Yep, this is absurd. I’m happy to see that Rock Art is working hard to stop this. They have a page on facebook and listed a bunch of links on BA.

If you own a trademark on a given name, you are obliged, by law, to defend it.

The fact that Monster is doing this doesn’t mean that they feel like the brewer is infringing on their brand. Could be someone just gave them the impression that they could lose their trademark rights if they let this slide. It’s entirely possible that they will send him letters, then "decide not to pursue it."

Better than even odds that they hate what this will do to their PR, and they find it a pointless PITA.

I don’t buy it, particularly based on the aforementioned Brooklyn Monster Ale...
